Psychiatric service dog letter in West Virginia

The White Cane Law in West Virginia (W. Va. Code 5-15-4) covers people with disabilities beyond blindness and hearing loss, and it focuses on animals individually trained to do tasks, much as the ADA does. In public you need no letter, but a landlord may ask for documentation.

How West Virginia PSD Letter works

A licensed clinician meets you by telehealth to discuss your symptoms and the tasks your dog performs. If you qualify, the signed letter is emailed within 24 hours after approval, ready for a West Virginia rental. If you don't qualify, no letter is issued.

Who it’s for, and who it isn’t

May be a fit

  • West Virginia handlers whose dog is trained to do tasks for a psychiatric condition
  • Renters who need to document that need
  • Handlers with up to 3 trained dogs

Usually not a fit

  • Dogs whose help is presence or comfort alone; an ESA letter fits
  • Anyone looking for a state license or certificate for their dog; West Virginia doesn't require one
  • Anyone under 18

What’s included

  • Telehealth evaluation with a licensed clinician
  • Signed letter with the clinician's license type, number and state
  • $149 covers 1 or 2 dogs and $229 covers 3
  • Emailed within 24 hours after approval

Possible side effects

  • No medical side effects
  • You are liable for damage your dog causes, unless someone else provoked it
  • On common carriers your dog must be leashed and can't occupy a seat

This isn’t a complete list. Your clinician reviews risks, interactions and warnings with you before prescribing. In an emergency, call 911.

What the evidence says

HUD's May 2026 enforcement guidance presumes housing requests for task-trained dogs are reasonable, and the ADA allows businesses two questions with no documentation. West Virginia's White Cane Law adds a state right of entry to hotels, restaurants, health offices and other public places, with no added admission charge.

Public places in West Virginia

A hotel, restaurant, clinic or other business open to the public must admit your trained service dog, and they can't charge extra admission for it. Under the ADA, staff may ask whether a disability requires the dog and what it has been trained to do, and nothing more.

West Virginia service animal rules

  • No state or local license or certification is needed for a service animal, and no special sign or label is required.
  • Certified trainers have the same rights and duties as handlers while training an animal.
  • On buses, trains and other common carriers, the animal must be leashed and can't take a seat.
  • You are liable for damage the animal causes, except when another person incited or provoked it.

Housing with a PSD in West Virginia

West Virginia's Fair Housing Act, 16B-18-5, lets a landlord ask for documentation of need but not medical records, and bars pet-fee conditions. If you're refused, use the Human Rights Commission's housing pre-complaint form or file with HUD.

Prescription treatments are available only to eligible patients after a clinical evaluation by an independently licensed clinician.
