1. About HealifyMD
HealifyMD operates HealifyMD.com and an online platform (the "Services") that helps adults connect with independently licensed clinicians for telehealth care. HealifyMD is a technology and administrative services company. HealifyMD does not practice medicine, nursing or pharmacy and does not provide medical advice.
Medical services are provided by independently licensed clinicians and their professional practices ("Providers"). Prescriptions are filled by independent licensed pharmacies, and laboratory tests are performed by independent clinical laboratories. Providers exercise independent professional judgment, and HealifyMD does not control or interfere with their clinical decisions.
2. Not for emergencies
The Services are not for medical emergencies or urgent care. If you think you may have a medical emergency, call 911 or go to the nearest emergency room. If you are having thoughts of harming yourself, call or text 988. Do not use messaging or email to report an emergency.
3. Eligibility
- You must be at least 18 years old.
- You must be physically located in a U.S. state where a Provider is licensed to treat you at the time of each visit, and you must tell us the truth about your location.
- You must provide accurate, current and complete information and keep it updated.
- You may use the Services only for yourself, not on behalf of another person, unless you are their legally authorized representative.
4. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly at support@healifymd.com if you suspect unauthorized use. We may suspend or close accounts that contain false information, are used in violation of these Terms or present a safety concern.
5. Medical care and prescriptions
Completing an intake or paying for a visit does not guarantee that you will receive a prescription or any particular treatment. A Provider decides whether treatment is appropriate, may order labs or a live video visit first, may recommend in-person care and may decline to prescribe. A Provider may also change or discontinue a treatment.
Some medications available through the Services are compounded by licensed pharmacies. Compounded medications are not FDA-approved, are not reviewed by the FDA for safety, effectiveness or quality and are not equivalent to branded products. Some treatments may be prescribed off-label. Your Provider will discuss these matters with you, and our Telehealth Informed Consent describes them further.
You agree to use any medication only as prescribed, to read the instructions provided, to report side effects to your care team and not to share medication with anyone else.
6. Educational content
Articles, guides and other content on HealifyMD.com are for general education only. They are not medical advice and do not create a clinician-patient relationship. Do not delay seeking care or disregard professional advice because of something you read on our website.
7. Prices and payment
- The eligibility check is free, and there is no membership fee.
- Prices for treatments and lab tests are shown on our website and confirmed during your eligibility review, before you are charged. Lab tests are priced separately from treatment.
- Some treatments are billed monthly on a recurring basis until you cancel. When you start a recurring plan, you authorize us to charge your payment method each billing period at the price confirmed to you.
- Our listed prices are self-pay prices. We do not bill insurance unless we tell you otherwise. You are responsible for any reimbursement you seek from an insurer or a flexible spending or health savings account.
- If a payment fails, we may pause shipments or services until it is resolved.
- We may change prices for future billing periods. We will notify you before a change applies to an active recurring plan, and you may cancel before it takes effect.
8. Cancellations and refunds
You may cancel a recurring plan at any time by emailing support@healifymd.com or through your account if that option is available. Cancellation stops future charges; it does not refund charges for a billing period that has already been processed or for a medication that has already been prescribed and sent to a pharmacy.
Because pharmacies cannot accept returns of dispensed prescription medications, medication charges are generally non-refundable once a prescription has been filled. If a Provider determines that you are not eligible for a treatment before it is prescribed, you will not be charged for that treatment. If you believe you were charged in error, contact us within 30 days of the charge and we will review it. Your Provider can advise whether a medication should be tapered rather than stopped.
9. Shipping
Pharmacies ship medications to the U.S. address you provide, in states where they are permitted to ship. You are responsible for providing a correct address and for being available to receive temperature-sensitive shipments. Report damaged, missing or incorrect shipments to support@healifymd.com promptly.
10. Acceptable use
- Do not provide false information, impersonate anyone or use someone else's account.
- Do not attempt to obtain medication for resale or for use by another person.
- Do not interfere with the security or operation of the Services, scrape content or attempt to access systems you are not authorized to use.
- Do not harass Providers or staff or use the Services for any unlawful purpose.
11. Intellectual property
The Services, including text, graphics, logos and software, are owned by HealifyMD or its licensors and protected by law. We grant you a limited, personal, non-transferable license to use the Services for their intended purpose. You may not copy, modify, distribute or create derivative works from our content without our written permission, except for personal, non-commercial use.
12. Privacy
Our Privacy Policy and HIPAA Notice of Privacy Practices explain how personal and health information is collected, used and protected. By using the Services, you acknowledge them.
13. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, HealifyMD disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. HealifyMD does not warrant any particular health outcome, does not guarantee that the Services will be uninterrupted or error-free and is not responsible for the professional judgment of Providers, pharmacies or laboratories, which are independent.
14. Limitation of liability
To the fullest extent permitted by law, HealifyMD will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from or related to your use of the Services. HealifyMD's total liability for any claim related to the Services will not exceed the amount you paid to HealifyMD in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
15. Indemnification
You agree to indemnify and hold harmless HealifyMD and its officers, employees and agents from claims, losses and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of the Services or your provision of false information.
16. Disputes
Before filing any claim, you agree to contact us at support@healifymd.com and try to resolve the dispute informally for at least 30 days. If the dispute is not resolved, it will be handled in the state or federal courts with jurisdiction over the matter, unless applicable law requires otherwise. You and HealifyMD each agree to bring claims only in an individual capacity, to the extent permitted by law.
17. Changes and termination
We may update these Terms from time to time. If we make material changes, we will update the effective date and notify you through the Services or by email. Continued use after changes take effect means you accept them. You may stop using the Services at any time. We may suspend or end your access if you violate these Terms or if continuing would be unsafe or unlawful; your Provider will help arrange appropriate transition of care where needed.
18. General
These Terms, together with the policies they reference, are the entire agreement between you and HealifyMD about the Services. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent.
