West Virginia ESA letters

ESA letter in West Virginia

West Virginia builds its assistance animal rules directly into its own Fair Housing Act, and it sets a fairly clear bar for documentation: paperwork showing the animal gives disability-related help or emotional support is enough. A landlord can't ask for your medical records.

How West Virginia ESA Letter works

Book a telehealth evaluation and talk through your symptoms and how your animal helps. West Virginia accepts documentation showing the animal provides disability-related assistance or emotional support, so the clinician addresses that point. If you qualify, the signed letter is emailed within 24 hours after approval. If you don't, no letter is issued.

Who it’s for, and who it isn’t

May be a fit

  • West Virginia renters in Charleston, Morgantown, Huntington or elsewhere facing a no-pets rule
  • Tenants whose landlord wants a pet fee or deposit before saying yes
  • People whose animal eases anxiety, depression, PTSD or a similar condition
  • Households with more than one support animal

Usually not a fit

  • Public places such as stores; ESAs have no public-access rights
  • Flights; airlines may treat ESAs as pets
  • Anyone seeking a registry listing or ID card
  • Anyone under 18

What’s included

  • Telehealth evaluation with a licensed clinician
  • Signed letter on letterhead with the clinician's license type, number and state
  • A letter that describes the support your animal provides
  • $129 covers 1 or 2 pets and $199 covers 3 or more
  • Emailed within 24 hours after approval

Possible side effects

  • No medical side effects; the risk is relying on the letter outside housing
  • A landlord can refuse an animal whose own behavior shows a direct threat or risk of substantial damage
  • Federal review of untrained ESAs is case by case under HUD's May 2026 guidance

This isn’t a complete list. Your clinician reviews risks, interactions and warnings with you before prescribing. In an emergency, call 911.

What the evidence says

Federal law under the Fair Housing Act and 24 CFR 100.204 requires landlords to consider reasonable accommodations, with untrained ESAs weighed case by case under HUD's May 2026 guidance. West Virginia's 16B-18-5 adds state limits: no unreasonable denial or delay, no pet-fee conditions, and denial only on credible evidence about the specific animal.

West Virginia law on assistance animals

  • Your landlord can ask for paperwork showing why your disability means you need the animal. Medical records are off limits.
  • Paperwork is sufficient when it shows the animal gives some form of disability-related help or emotional support.
  • Under 16B-18-5(10), requests can't be unreasonably denied or delayed, and approval can't hinge on pet fees or deposits.
  • To deny, the landlord needs credible proof, based on how that specific animal has actually behaved, that it is a direct threat or would cause substantial damage.
  • A legislative rule, W. Va. Code R. 71-9, took effect in February 2025 and adds further detail.

What a West Virginia landlord can and can't ask

They can ask for a letter linking your disability to the animal. They can't ask for medical records, make you pay a pet fee first, or turn the animal down without credible evidence drawn from its own behavior.
