What the evidence says
HUD's May 2026 enforcement guidance presumes that housing requests for task-trained dogs, psychiatric service dogs included, are reasonable. In public places the ADA allows two questions and no paperwork. Virginia's 51.5-44 adds a state right of entry and imagines the dog wearing identifying gear, a detail the ADA does not demand.
Public places in Virginia
Restaurants, hotels and other public accommodations in Virginia must admit your trained service dog without an extra charge. Under the ADA, staff can ask whether a disability requires the dog and what it has been trained to do. They can't ask for a letter.
Virginia's statute describes the dog in a harness, backpack or vest that identifies it. Federal law doesn't require gear, but carrying it may make visits smoother.
Virginia service dog rules
- A dog in training aged six months or older may accompany an experienced trainer when it wears gear showing its role.
- Under 51.5-44.1, putting a vest, harness or ID card on a dog to fraudulently pass it off as a working dog is a Class 4 misdemeanor.
- Under Va. Code 18.2-11, a Class 4 misdemeanor is punished by a fine of up to $250 and no jail.
- The same law also mentions guide dogs working in harness, and hearing dogs identified by a blaze orange leash.
Housing with a PSD in Virginia
Va. Code 36-96.3:1 lets a provider ask for reliable documentation unless your disability and need are already obvious, and bars pet fees and deposits for assistance animals. If a request is refused, file in writing with the Virginia Fair Housing Office within one year, or with HUD.
Prescription treatments are available only to eligible patients after a clinical evaluation by an independently licensed clinician.
