Virginia ESA letters

ESA letter in Virginia

Virginia writes its assistance animal rules into its own fair housing statute, and it goes further than many states: no pet fee, pet deposit or added rent for an assistance animal. The statute also describes the kind of relationship the person writing your letter should have with you.

How Virginia ESA Letter works

A licensed clinician evaluates you by telehealth, asking about your symptoms and the role your animal plays. Virginia says supporting documentation can come from someone who has or had a therapeutic relationship with you, such as a mental health provider giving good-faith care, and the evaluation is where that relationship begins. If you qualify, the signed letter arrives by email within 24 hours after approval. If not, no letter is issued.

Who it’s for, and who it isn’t

May be a fit

  • Virginia renters in Richmond, Norfolk, Arlington or anywhere in the Commonwealth facing a no-pets policy
  • Tenants being charged pet rent or a pet deposit for an animal that supports a disability
  • People whose animal helps with anxiety, depression, PTSD or a similar condition
  • Households with more than one support animal

Usually not a fit

  • Bringing an animal into shops or restaurants; ESAs have no public-access rights
  • Air travel; airlines may treat ESAs as pets
  • Anyone wanting training credentials or certification; Virginia providers can't require them
  • Anyone under 18

What’s included

  • Telehealth evaluation with a licensed clinician
  • Signed letter on letterhead showing the clinician's license type, number and state
  • $129 covers 1 or 2 pets and $199 covers 3 or more
  • Emailed within 24 hours after approval

Possible side effects

  • No medical side effects; the risk is assuming the letter works outside housing
  • You still pay for physical damage the animal causes, even though fees and deposits are barred
  • HUD's May 2026 guidance means untrained ESAs are weighed individually, so the outcome is not automatic

This isn’t a complete list. Your clinician reviews risks, interactions and warnings with you before prescribing. In an emergency, call 911.

What the evidence says

Under the Fair Housing Act and 24 CFR 100.204, landlords must consider reasonable accommodations, and HUD's May 2026 guidance says untrained ESAs are assessed one case at a time. Virginia's 36-96.3:1 layers state rules on top: documentation limits, a ban on pet fees for assistance animals, and consumer protection penalties for fraudulent letters.

Virginia law on assistance animals

  • A housing provider can ask for reliable proof of your disability and of why you need the animal, except where both are already plain or known to them.
  • If they already know about your disability but not the need, they can ask only to verify the need.
  • No pet fee, pet deposit or extra rent may be charged for an assistance animal, though you remain liable for physical damage.
  • Under 36-96.3:1(F), writing fake supporting paperwork is treated as a banned practice under Virginia's consumer protection law.

Who can write the letter in Virginia

Virginia accepts documentation from a person with whom you have, or had, a therapeutic relationship, and gives a mental health provider offering good-faith care as an example. Your HealifyMD letter comes from a licensed clinician who evaluated you and lists their license type, number and state, so a landlord can see who wrote it.

If your request is denied in Virginia

Send a written complaint to the Virginia Fair Housing Office at DPOR within one year. The office also notes that a provider can't insist on special training or certification for an assistance animal. A federal complaint to HUD is another route.

Prescription treatments are available only to eligible patients after a clinical evaluation by an independently licensed clinician.

Virginia ESA Letter: common questions

Can a Virginia landlord charge pet rent for my ESA?

Is there a penalty for fake ESA letters in Virginia?

Yes. Virginia treats a provider's fake supporting paperwork as a banned practice under its consumer protection law.

How long do I have to file a fair housing complaint in Virginia?

The Virginia Fair Housing Office accepts written complaints within one year.

What does the Virginia ESA letter cost?

$129 covers 1 or 2 pets and $199 covers 3 or more. It is emailed within 24 hours after approval.
