What the evidence says
Under HUD's May 2026 guidance, housing requests for task-trained psychiatric service dogs are presumptively reasonable. Under the ADA, businesses may ask two questions and can't require documentation. Indiana's IC 16-32-3 and 16-32-3.5 follow the same model, covering dogs or miniature horses trained for a disability and allowing no demand for certification.
Public places under the ADA and Indiana law
In Indiana, staff may ask only the two ADA questions. They can't ask for a certificate or letter.
- IC 16-32-3-2 gives trainers working with a service animal the same access, if the animal is under control
- Turning a team away, or adding a fee for the animal, is a Class C infraction
- Striking, injuring or interfering with a working service animal is a Class A misdemeanor, and a felony for serious harm (IC 35-46-3-11.5)
Work and housing in Indiana
At work, Indiana civil rights law means an employer can't bar an employee with a disability from having a service animal on the job. In rentals, a landlord may ask for reliable information about a need that isn't obvious, and a clinician's letter provides it.
If you are refused in Indiana
The Indiana Civil Rights Commission handles discrimination complaints. Federal housing complaints go to HUD.
Prescription treatments are available only to eligible patients after a clinical evaluation by an independently licensed clinician.
