- You remain liable for damage your dog causes
This isn’t a complete list. Your clinician reviews risks, interactions and warnings with you before prescribing. In an emergency, call 911.
What the evidence says
HUD's May 2026 guidance treats housing requests for task-trained dogs as presumptively reasonable, and the ADA limits businesses to two questions with no documentation. Florida's 413.08 gives handlers full and equal access without extra fees and keeps service animals legally separate from ESAs.
Florida service animal law
- Fla. Stat. 413.08 covers public accommodations, employment and housing, with full and equal access and no extra fees.
- 413.08(8) puts trainers on the same footing as handlers, both for access and for paying for damage.
- Knowingly claiming to be a handler or trainer when you aren't is a second-degree misdemeanor, and the court adds 30 hours of community service to finish within six months.
Florida rentals
Florida landlords may not add a charge for a service animal. They are allowed to ask you to show the dog's vaccinations are current as required. The housing parts of 413.08 cover service animals only; ESAs fall under 760.27.
Public places under the ADA
Staff can ask two things: is the dog needed for a disability, and which task does it perform? They can't ask for anything else, including a letter.
If a Florida landlord refuses
File with the Florida Commission on Human Relations or with HUD.
Prescription treatments are available only to eligible patients after a clinical evaluation by an independently licensed clinician.
Florida PSD Letter: common questions
Can a Florida landlord ask for my service dog's vaccination records?
Yes. They can't charge extra for a service animal, but they may ask for proof it meets vaccination requirements.
Does Florida's in-person rule for ESA letters apply to PSD letters?
That rule sits in 760.27, the ESA statute. Service animals are covered by 413.08.
Are trainers protected in Florida?
Yes. A trainer has the same access rights as a handler, and the same liability for damage.
What is the penalty for faking a service animal in Florida?
It is a second-degree misdemeanor, and 30 hours of community service must be completed within six months.
How much is the letter?
$149 covers 1 or 2 dogs. A letter for 3 dogs is $229.
