New Hampshire ESA letters

ESA letter in New Hampshire

New Hampshire has no emotional support animal law, so a request in Manchester, Concord or Durham is a federal reasonable accommodation request. One local wrinkle: some owner-occupied buildings and small rentals may fall outside the federal Fair Housing Act, so it pays to ask early.

How New Hampshire ESA Letter works

Book a telehealth evaluation. You'll discuss your symptoms and how your animal helps. If the clinician finds you qualify, your signed letter is emailed within 24 hours after approval for your New Hampshire housing request. If you don't qualify, no letter is issued.

Who it’s for, and who it isn’t

May be a fit

  • New Hampshire renters facing a no-pets lease
  • Students and tenants in college towns who need documentation for housing
  • People with a mental health condition whose animal eases their symptoms
  • Households with more than one support animal

Usually not a fit

  • Public places; RSA 167-D is about trained service animals, not ESAs
  • Air travel, where airlines may treat ESAs as pets
  • Anyone looking for an ESA certificate or registry
  • Anyone under 18

What’s included

  • Telehealth evaluation with a licensed clinician
  • Signed letter on letterhead with license type, number and state
  • $129 covers 1 or 2 pets; $199 covers 3 or more
  • Emailed within 24 hours after approval

Possible side effects

  • No medical side effects; the letter is for housing only
  • If you rent from a resident owner or a very small landlord, the federal Fair Housing Act may not apply
  • HUD's May 2026 guidance reviews untrained ESAs case by case, so a landlord may still decline

This isn’t a complete list. Your clinician reviews risks, interactions and warnings with you before prescribing. In an emergency, call 911.

What the evidence says

With no state ESA statute, New Hampshire tenants rely on the Fair Housing Act and 24 CFR 100.204. HUD's May 2026 enforcement guidance reviews untrained ESAs case by case. The New Hampshire Commission for Human Rights, set up under RSA 354-A, enforces the state's own housing discrimination ban.

New Hampshire law and emotional support animals

There's no ESA-specific law in New Hampshire. RSA 167-D, the state's service animal chapter, deals with trained service animals and gives ESAs no separate rights.

RSA 354-A prohibits housing discrimination, and the Commission for Human Rights enforces it alongside its work on employment and public accommodation.

What a New Hampshire landlord can and can't ask

  • Can ask for a short note from a licensed provider linking your animal to your disability
  • Can't require your diagnosis or medical records
  • May be exempt from the federal Fair Housing Act if they live in the building or own only a few units, so ask early

If your request is denied in New Hampshire

Contact the New Hampshire Commission for Human Rights, which handles housing discrimination under RSA 354-A. You can also file a federal complaint with HUD.

Prescription treatments are available only to eligible patients after a clinical evaluation by an independently licensed clinician.
