How Kentucky ESA Letter works

Book a telehealth evaluation with a licensed clinician. Before you rely on any letter in Kentucky, check the license state shown on it against KRS 383.085, which generally expects a Kentucky license, active practice in the state and an ongoing therapeutic relationship. If you qualify, the signed letter is emailed within 24 hours after approval. If not, no letter is issued.

Who it’s for, and who it isn’t

May be a fit

  • Kentucky renters who want to understand the state's provider rules before requesting an accommodation
  • People who recently moved to Kentucky and have an ongoing relationship with a provider in their former state
  • People with a mental health condition whose animal eases symptoms
  • Households with more than one support animal

Usually not a fit

  • Anyone who needs a letter that meets KRS 383.085 but cannot confirm the provider's Kentucky license and practice
  • Public places and flights; ESAs have no public-access rights
  • Anyone seeking a letter-for-a-fee with no ongoing care
  • Anyone under 18

What’s included

  • Telehealth evaluation with a licensed clinician
  • Signed letter on letterhead showing the clinician's license type, number and state, so you and your landlord can check it
  • $129 for up to 2 animals, or $199 for 3 or more
  • Emailed within 24 hours after approval

Possible side effects

  • No medical side effects; the main risk is a letter a Kentucky landlord can reject under KRS 383.085
  • Knowingly faking a need or submitting false papers can bring a fine of up to $1,000
  • You remain liable for physical damage the animal causes

This isn’t a complete list. Your clinician reviews risks, interactions and warnings with you before prescribing. In an emergency, call 911.

What the evidence says

Federally, the Fair Housing Act and 24 CFR 100.204 require reasonable accommodations, and HUD's May 2026 guidance reviews untrained ESAs case by case. Kentucky's KRS 383.085, part of its landlord-tenant law, lets a landlord request documentation when the need isn't obvious and narrowly defines who counts as a qualifying provider. Once approved, the animal can't be charged a pet fee, deposit or extra rent.

Kentucky law on who can write ESA documentation

KRS 383.085 limits qualifying providers to clinicians with an unrestricted Kentucky license who actively practice in Kentucky and have an ongoing therapeutic relationship with you. Eligible license types include:

  • Licensed clinical social workers
  • Licensed professional counselors
  • APRNs
  • Psychologists
  • Physicians

Exceptions and limits

  • New Kentucky residents may use documentation from a provider back in their previous state, so long as treatment with that provider is ongoing
  • Clinicians whose main business is selling letters are not qualifying providers, and providing documentation chiefly for payment is itself an offense
  • Knowingly faking a need, disguising a pet as an assistance animal or handing over false documents can cost up to $1,000

What a Kentucky landlord can and can't ask

A landlord may ask for documentation from a qualifying provider when your need isn't obvious. Once your animal is approved, they can't charge a pet fee, deposit or extra rent, but they can hold you liable for physical damage.

If your request is denied in Kentucky

The Kentucky Commission on Human Rights takes housing discrimination complaints. Federal complaints go to HUD.

Prescription treatments are available only to eligible patients after a clinical evaluation by an independently licensed clinician.
