Kansas ESA letters

ESA letter in Kansas

Kansas has no statute written just for emotional support animals, but its own anti-discrimination law joins the federal Fair Housing Act in requiring landlords to make reasonable accommodations. A letter from a clinician who evaluated you is the usual way to support that request.

How Kansas ESA Letter works

Book a telehealth evaluation. A licensed clinician asks about your symptoms and how your animal helps. If they conclude that you qualify, your signed letter is emailed within 24 hours after approval. If you don't qualify, no letter is issued.

Who it’s for, and who it isn’t

May be a fit

  • Renters in Wichita, Overland Park, Topeka, Lawrence or elsewhere in Kansas with a no-pets policy
  • People with a mental health condition whose animal helps them cope
  • Tenants asked for documentation because their disability isn't visible
  • Households with more than one support animal

Usually not a fit

  • Stores, restaurants and other public places; Kansas assistance dog law excludes comfort animals
  • Air travel; airlines may treat ESAs as pets
  • Anyone looking for a registry or certificate
  • Anyone under 18

What’s included

  • Telehealth evaluation with a licensed clinician
  • Signed letter on letterhead with the clinician's license type, number and state
  • $129 covers 1 or 2 animals; $199 covers 3 or more
  • Emailed within 24 hours after approval

Possible side effects

  • No medical side effects; the risk is relying on the letter outside housing
  • Untrained ESAs are reviewed case by case under HUD's 2026 guidance
  • You still pay for any damage your animal causes

This isn’t a complete list. Your clinician reviews risks, interactions and warnings with you before prescribing. In an emergency, call 911.

What the evidence says

The Fair Housing Act and 24 CFR 100.204 require reasonable accommodations, and HUD's May 2026 guidance weighs untrained ESAs case by case. Kansas reaches the same place through the Kansas Act Against Discrimination: K.S.A. 44-1016 lists refusal of a reasonable accommodation for a person with a disability as an unlawful housing practice. Kansas sets no waiting period, so federal documentation standards govern.

How Kansas law treats ESAs

  • K.S.A. 44-1016 makes refusing a reasonable accommodation for a disability an unlawful housing practice
  • Kansas sets no minimum treatment period before an ESA letter
  • Kansas assistance dog law says a comfort dog is not an assistance dog, so ESAs have no public-access rights in the state

What a Kansas landlord can and can't ask

Federal HUD guidance shapes what documentation a Kansas landlord may request. If your disability isn't apparent, they may ask for reliable information from a clinician. They should not demand your diagnosis or full medical records.

If your request is denied in Kansas

The Kansas Human Rights Commission is the state office for housing discrimination complaints. You can also file with HUD. Note the date of your request and any reply.

Prescription treatments are available only to eligible patients after a clinical evaluation by an independently licensed clinician.
