Texas PSD letters

Psychiatric service dog letter in Texas

Texas adds its own public access right in Human Resources Code Chapter 121, which works next to the ADA. A clinician's letter isn't needed there, but it is the usual way to document your need with a Texas landlord.

How Texas PSD Letter works

Book a telehealth evaluation. The clinician asks about your psychiatric symptoms and the tasks your dog is trained to perform. If you qualify, the signed letter is emailed within 24 hours after approval, ready for a Texas lease application or renewal. If you don't qualify, no letter is issued.

Who it’s for, and who it isn’t

May be a fit

  • Texas handlers whose dog is trained to do tasks for a psychiatric condition
  • Renters who need to document that need for a landlord
  • Handlers with up to 3 trained dogs

Usually not a fit

  • Dogs that help through companionship alone; an ESA letter is the honest choice
  • Anyone expecting the letter to replace training
  • Anyone under 18

What’s included

  • Telehealth evaluation with a licensed clinician
  • Signed letter with the clinician's license type, number and state
  • $149 covers 1 or 2 dogs and $229 covers 3
  • Emailed within 24 hours after approval

Possible side effects

  • No medical side effects
  • Passing off a pet as a service animal in Texas risks a fine as high as $1,000, plus community service
  • You remain responsible for your dog's behavior and any damage

This isn’t a complete list. Your clinician reviews risks, interactions and warnings with you before prescribing. In an emergency, call 911.

What the evidence says

HUD's May 2026 enforcement guidance treats housing requests for task-trained dogs as presumptively reasonable. Under the ADA, businesses may ask only two questions and can't require documentation. Texas Chapter 121 sits beside the ADA, and its definition covers dogs that have special training or equipment to assist someone with a disability.

Public places in Texas

Both the ADA and Chapter 121 require Texas businesses to let a trained service dog in. Staff are limited to asking whether a disability requires the dog and what it has been trained to do.

If a business refuses you, the Governor's Committee on People with Disabilities suggests making a police report or filing in small claims court, which you can do without a lawyer.

Texas service animal rules

  • A service animal in training can't be excluded from a public facility when an approved trainer is with it (121.003(i)).
  • Section 121.006 punishes a knowing false service animal claim with a fine that can reach $1,000, along with 30 hours of community service.
  • Attacking, harassing, hurting or getting in the way of a working service animal is its own offense in Texas.
  • Enforcement is mostly local, through police and prosecutors.

Renting in Texas with a PSD

If your need isn't obvious, a Texas landlord may ask for reliable documentation. If they refuse your request, you can file with the TWC Civil Rights Division within one year, or with HUD, but not both.

Prescription treatments are available only to eligible patients after a clinical evaluation by an independently licensed clinician.
