What the evidence says

HUD's May 2026 enforcement guidance presumes housing requests for task-trained animals, psychiatric service dogs included, are reasonable. The ADA limits businesses to two questions and no documentation demands, and Rhode Island's chapter 40-9.1 adds state public access rights.

Rhode Island service animal law

Under chapter 40-9.1, a disabled person may take a specially trained service animal into public places, and no extra payment can be required. In state law, a service animal means a dog trained, or currently in training, to help someone with a disability; guide and hearing dogs are included.

Under 40-9.1-2.1, trainers and puppy raisers have the same access rights as handlers and are responsible for damage during training.

Public places under the ADA

Staff may only ask if the dog is needed for a disability and which task it is trained to do. They can't require a letter.

False claims in Rhode Island

  • Under 40-9.1-3.1 it is a civil violation to expressly tell a public place your pet is a service animal to get in, if you knew or ought to have known otherwise
  • The penalty can include court-ordered community service, up to 30 hours, with a group that serves people with disabilities
  • The handler, not the business, is liable for damage the animal does to people, premises or facilities

If a Rhode Island landlord refuses

If a landlord refuses, file a charge with the Rhode Island Commission for Human Rights or with HUD.

Prescription treatments are available only to eligible patients after a clinical evaluation by an independently licensed clinician.
