North Carolina ESA letters

ESA letter in North Carolina

In North Carolina, an emotional support animal request goes through the State Fair Housing Act in Chapter 41A, which closely mirrors federal law. Asking a landlord to waive a no-pets rule is a standard reasonable accommodation, and a clinician's letter supports it.

How North Carolina ESA Letter works

Schedule a telehealth evaluation and answer questions about your symptoms and how your animal helps day to day. When the clinician approves you, your signed letter with their license type, number and state is emailed within 24 hours. No letter is issued if you don't qualify.

Who it’s for, and who it isn’t

May be a fit

  • North Carolina renters whose lease bans pets or caps them
  • People with a mental health condition that their animal helps ease
  • Tenants who need fresh documentation at move-in or renewal
  • Households with more than one support animal

Usually not a fit

  • Public access; North Carolina's tenancy right in G.S. 168-4.2 is for trained service animals, not ESAs
  • Flights; airlines may treat an ESA as a pet
  • Anyone seeking an ESA registry listing or ID
  • Anyone under 18

What’s included

  • Telehealth evaluation with a licensed clinician
  • Signed letter on letterhead with the clinician's license type, number and state
  • $129 for up to 2 animals, or $199 for 3 or more
  • Letter emailed within 24 hours after approval

Possible side effects

  • No medical side effects; the risk is relying on the letter for something it doesn't cover
  • Untrained ESAs are reviewed case by case under HUD's May 2026 guidance
  • The letter doesn't protect you from paying for damage

This isn’t a complete list. Your clinician reviews risks, interactions and warnings with you before prescribing. In an emergency, call 911.

What the evidence says

Under the Fair Housing Act and 24 CFR 100.204, housing providers must make reasonable accommodations for people with disabilities, and HUD's May 2026 guidance reviews untrained ESAs case by case. North Carolina's G.S. 41A-4 says the same at state level: refusing a reasonable change to rules a disabled person needs to use and enjoy a home is unlawful.

North Carolina law on emotional support animals

North Carolina hasn't passed a separate ESA statute. Chapter 41A of the General Statutes, the State Fair Housing Act, tracks the federal law, and Under Section 41A-4, a landlord acts unlawfully by refusing a reasonable change to rules or policies when a tenant with a disability needs it to use and enjoy a home.

Waiving a no-pets rule for an ESA is a textbook example of that kind of change. The tenancy right for animals in G.S. 168-4.2 is different: it applies to trained service animals, so an ESA relies on the fair housing route.

What a North Carolina landlord can and can't ask

  • They can ask for reliable information about your need when the disability isn't obvious
  • They can't require your diagnosis or medical records
  • They can weigh an untrained ESA request case by case under HUD's 2026 guidance
  • They can still expect you to cover damage the animal causes

If your request is denied in North Carolina

The State Fair Housing Act is now enforced by the Office of Administrative Hearings through its Housing Discrimination Section, which accepts complaints by email. G.S. 41A-7 gives you one year from the discriminatory practice to file. Staff can help you write the complaint.

You can also file a federal complaint with HUD.

Prescription treatments are available only to eligible patients after a clinical evaluation by an independently licensed clinician.
